1. Agreement and service provider
These Terms govern your purchase and use of RoamAid Trip Protection and related assistance services (the “Services”) provided by ROAMAID INC (“RoamAid,” “we,” “us”). “You” means the purchaser and, where appropriate, the traveler receiving Services. Each Trip Protection purchase is a separate agreement governed by the Terms accepted for that purchase and its confirmed purchase details. Our Privacy Policy explains how personal information is handled.
Section 17 contains an individual arbitration agreement and class-action waiver, with exceptions and a separate 30-day opt-out opportunity for each purchase. Read it carefully.
2. Eligibility and covered family members
The purchaser must be the Primary Traveler, at least 18 years old, legally capable of entering into an agreement, a U.S. resident, and have a working U.S. mobile phone number used during the trip. Listed family members need not be U.S. residents or have separate U.S. phone numbers. RoamAid may refuse, suspend or cancel an ineligible purchase, subject to applicable law and refund provisions.
One purchase covers the Primary Traveler and may include one spouse or partner and up to five children, for a maximum of seven covered people at any one time. A spouse or partner is not required for children to be included. Friends, siblings, coworkers, unlisted companions and other persons are not covered. Covered family members must appear on the confirmed trip record and follow the Primary Traveler’s confirmed itinerary.
The purchaser may request that an eligible family member be added, removed or replaced before 12:00 a.m. Pacific Time on the confirmed Start Date, provided the updated list does not exceed seven covered people. RoamAid’s system will check eligibility, update the trip record, and immediately tell the agent whether the change was confirmed or rejected. After the Start Date, no new family member may be added or substituted. RoamAid may correct a clerical error that does not change a listed person’s identity or create coverage retroactively. A family-list change does not extend the trip’s dates or other service limits.
Listed family members are covered only while traveling with the Primary Traveler under the same confirmed itinerary and at the same applicable destination. They do not need to remain physically beside the Primary Traveler at every moment. If a listed family member separates from that itinerary, remains behind, or travels independently to another destination, only that person’s coverage ends. The Primary Traveler and remaining listed family members remain covered while continuing together on the same confirmed itinerary and at the same applicable destination, subject to the other requirements of these Terms.
A listed child must be under 18 on the confirmed Start Date and accompanied by a parent traveling under the same covered itinerary. A child who turns 18 during the confirmed Trip Protection period remains eligible through that period’s End Date, subject to the other requirements of these Terms.
Family coverage does not extend the purchase’s confirmed dates, destinations or other service limits. Listing another person does not by itself establish that person’s consent to automated messages or recording, or authority to waive that person’s independent legal rights.
3. What RoamAid provides-and its limits
RoamAid provides travel assistance within the scope of the purchased Trip Protection, including telephone assistance and access to live human telephone interpretation, and selected optional features such as Automatic Safety Check-Ins and Emergency Contact Notification. Optional features depend on the required setup, consent and verification described below.
RoamAid is not 911, police, EMS, an ambulance service, a hospital, a medical provider, a government agency, an embassy or consulate, an emergency dispatcher, or an insurer. RoamAid does not guarantee rescue, emergency response, a particular third-party action or a particular outcome.
If immediate or life-threatening assistance is needed, contact the appropriate local emergency services directly whenever reasonably possible. If you do not know whom to contact, how to reach them, or need help communicating, you may contact RoamAid for assistance within the scope of the Services.
During an active Trip Protection period, you may call RoamAid at any time for assistance or text HELP to the RoamAid number provided with your booking, subject to service and communications availability. Email is available for administrative matters and is not a substitute for an urgent assistance call.
RoamAid Trip Protection is a travel assistance service, not insurance. ROAMAID INC is not an insurance company, broker, agent or insurer. Unless RoamAid expressly agrees in writing to a specific reimbursement, it does not promise reimbursement for medical treatment, evacuation, transportation, trip cancellation or interruption, lost or stolen property, delays, accidents, injuries, emergency-service charges or other travel losses. You remain responsible for third-party expenses and obtaining any insurance you consider appropriate.
4. Price, payment and protection period
The current Trip Protection price is $19.99 per purchase for up to 30 days; your confirmed purchase identifies its dates and selected services. A shorter trip does not automatically receive 30 days of protection. The price does not vary merely because available optional features are selected or omitted. Review the total presented before payment.
Trip Protection becomes active only after RoamAid receives and authoritatively verifies successful payment. Subject to that prerequisite, protection begins at 12:00 a.m. Pacific Time on the confirmed Start Date and continues through 11:59 p.m. Pacific Time on the confirmed End Date, unless earlier ended under these Terms. There is no protection before the confirmed Start Date, and later payment verification does not retroactively activate Services for an earlier unverified period.
A pending, failed, canceled, reversed or unverified payment does not establish active Trip Protection. A checkout-page return alone is not confirmation. Services outside the active protection period are not covered by that purchase.
5. Cancellation and refunds
You qualify for a full refund if RoamAid receives your cancellation request at least 24 hours before 12:00 a.m. Pacific Time on the confirmed Trip Protection Start Date. Send administrative cancellation requests to info@roamaid.me and identify the relevant trip.
Cancellations received after that cutoff, including after activation, are nonrefundable, subject to nonwaivable legal rights and correction of duplicate charges or payment errors. Not using a selected feature, or disabling it after activation, does not itself create a refund entitlement.
6. Travel dates and destination changes
You may request changes to confirmed protection dates only if RoamAid receives the request at least 24 hours before both the currently confirmed Start Date and any requested revised Start Date, measured from 12:00 a.m. Pacific Time on each date. The revised period must remain within the maximum duration for one purchase. Changes take effect only when RoamAid confirms them and updates the trip record. After the applicable deadline or activation, different or additional dates may require another purchase.
You may request destination changes before or during the active trip without a 24-hour advance deadline. They become effective for Services only after RoamAid confirms them and updates the trip record. Notify us promptly because destination changes can affect time zones, check-ins, communications and local resources. A destination change does not extend the End Date and remains subject to geographic and legal availability.
7. Automatic Safety Check-Ins and HELP
When selected and operational, Automatic Safety Check-Ins follow the confirmed schedule and selected SMS, WhatsApp or Both channels. Scheduled local times follow the applicable destination on the check-in date. Complete the requested channel verification; verification of one channel does not verify another. A response to an initial verification message is not a response to a later scheduled check-in.
Reply Y or YES to a scheduled check-in if you are safe and okay, or HELP if you need assistance. For Both channels, the planned sequence is WhatsApp first, followed by SMS after 10 minutes without an affirmative safety response. If the SMS attempt also receives no affirmative response during its 10-minute window, RoamAid alerts an agent to call and initiates an emergency-contact notification at the same stage when that feature is selected and its consent requirements are satisfied. An unavailable channel can count as an unanswered attempt; this does not mean its message was delivered.
When SMS only or WhatsApp only is selected, both check-in attempts use that channel. If no Y or YES response is received within ten minutes of the first attempt, RoamAid sends a second check-in through the same channel. If neither attempt receives an affirmative safety response by the end of the second ten-minute window, RoamAid simultaneously alerts an agent to call and initiates Emergency Contact Notification when selected and the contact has provided the required consent. A Y or YES response resolves the check-in and cancels pending escalation. If the selected channel is unavailable, the failed attempt counts toward the same escalation sequence but is not recorded as successfully delivered. RoamAid does not switch to a channel the customer did not select.
A received HELP request triggers immediate escalation to an agent for a callback rather than waiting for a scheduled response window. If the agent reaches you, the agent asks whether you want your emergency contact notified. If you cannot be reached, the planned procedure is three call attempts spaced three minutes apart, followed by emergency-contact notification after the third unanswered attempt where the feature and required consent are in place. A HELP request or missed check-in does not by itself establish that an injury or emergency has occurred.
These intervals describe the intended procedure, not a guarantee of message delivery, agent connection, third-party response or assistance within a fixed time. The service and communications limitations in these Terms apply.
8. STOP and reactivation
You may reply STOP to stop automated check-ins on that channel. RoamAid records the request for the applicable trip and channel; provider-level restrictions may affect a broader set of messages and will be respected. Do not assume that a new booking or changed setting automatically removes a provider restriction.
For Both channels, stopping WhatsApp does not itself stop the separately selected and permitted SMS channel. The SMS backup may proceed after the applicable 10-minute interval. If you stop both channels, automated check-ins and automatic missed-check-in emergency-contact alerts stop for that trip. The related agent alert is not itself an emergency-contact notification.
For SMS-only or WhatsApp-only service, STOP on the sole selected channel disables automated check-ins and automatic missed-check-in emergency-contact alerts for that trip. It cancels the pending reminder and missed-check-in escalation. STOP itself is not treated as evidence of danger.
You can still call for assistance or initiate a HELP request. Stopping automated check-ins does not cancel a customer-initiated assistance request. Restarting requires an affirmative request and completion of RoamAid’s reactivation process and any provider requirements. Reactivation does not erase the earlier STOP history or create retroactive check-ins.
RoamAid text messages. RoamAid may text verification codes, trip confirmations (for customers who selected SMS or WhatsApp check-ins), scheduled safety check-ins, replies to HELP, and STOP/START confirmations. Frequency varies with your chosen schedule. Msg & data rates may apply. Reply STOP to cancel or HELP for help, or contact +1 408-762-6243 or info@roamaid.me. Carriers are not liable for delayed or undelivered messages. Consent to recurring messages is not a condition of purchase.
9. Emergency contacts
If you provide an emergency contact, you represent that you are authorized to supply their information for purposes related to your Trip Protection and safety assistance. You cannot give automated messaging consent on their behalf. The contact must separately and affirmatively consent through the required process before automated text notifications requiring that consent become operational. Silence is not consent; NO or STOP declines or withdraws consent.
If the contact has consented, you authorize RoamAid to contact them under the applicable service procedures, including relevant missed check-ins or assistance requests. RoamAid may share limited information reasonably necessary for that purpose, such as your name, a missed check-in, our attempt to reach or assist you, and a request for the contact to try reaching you.
Keep contact information accurate and current. Designation does not guarantee consent, reachability, a response or any particular action. If consent is missing or withdrawn, automated notifications requiring it are unavailable. Any invitation to consent must itself use a legally permitted process.
10. Changes and optional services during an active trip
During an active Trip Protection period, you may request changes to available service settings or add an available optional feature, including Automatic Safety Check-Ins or Emergency Contact Notification.
A request becomes effective only after RoamAid confirms it, updates the trip record, and completes required consent, contact verification, scheduling and operational steps. New or changed features apply prospectively; they do not create responsibility for earlier events or communications.
Changes do not extend the End Date, erase historical records or override an earlier STOP request. Restarting a stopped channel requires the separate affirmative reactivation process. RoamAid does not charge an additional Trip Protection fee merely for adding an available optional feature during the same active period. Removing or choosing not to use a feature after activation does not create a refund entitlement except as otherwise stated here or required by law.
11. Customer information, connectivity and no continuous monitoring
Provide accurate, complete and current names, contact information, travel dates, destinations, communication selections and emergency-contact information. Promptly tell RoamAid about material changes. RoamAid may reasonably rely on supplied information. To the extent permitted by law, RoamAid is not responsible for service problems caused by inaccurate, incomplete, outdated or unauthorized information you provide.
For SMS, maintain a compatible functioning device and mobile service capable of sending and receiving messages at your location, including roaming where necessary. For WhatsApp, maintain access to the account associated with your supplied number and a functioning internet connection. You are responsible for device settings and carrier, roaming, messaging, data and internet charges.
RoamAid does not continuously monitor your location, GPS position, device, health, surroundings, activities or safety. Scheduled check-ins are not continuous monitoring. RoamAid does not know that you need assistance merely because an unsafe event occurs between check-ins. Do not rely on RoamAid to detect an emergency automatically.
12. Languages, geography and service availability
Review the current Languages list on the RoamAid website before purchase. RoamAid uses reasonable efforts to connect you with a live professional human telephone interpreter in a supported language within the applicable assistance service. The list can change as provider coverage changes; inclusion does not guarantee immediate availability or a fixed connection time. No fixed language count or AI interpretation is promised.
RoamAid is designed to assist travelers wherever they travel, subject to law and reasonably available services, networks, providers and resources. RoamAid will use reasonable efforts to provide assistance within your purchased scope that is lawfully and reasonably available at your location. Methods may vary and reasonable alternatives may be attempted, without a guarantee of availability or success.
Services depend on independent telecommunications, internet, messaging, interpretation, payment and technology providers, and may involve emergency responders, hospitals, government agencies, embassies, consulates or other third parties. RoamAid cannot override their decisions, local laws or restrictions.
RoamAid does not guarantee uninterrupted, error-free or timely service, communication delivery, interpreter availability or third-party response. To the extent permitted by law, RoamAid is not responsible for failures caused by circumstances outside its reasonable control, including network or power failures, provider outages, blocked communications, cyber incidents, severe weather, natural disasters, war, terrorism, civil unrest, strikes, government restrictions and public emergencies. These limitations do not eliminate express commitments or liability that cannot lawfully be excluded.
13. Recording, transcription and data retention
RoamAid records calls after providing notice and obtaining any consent required by applicable law. If a participant objects, RoamAid will stop recording as soon as operationally possible and continue assistance without recording. Newly joined participants receive notice when the call is being recorded, subject to any legally valid, verified provider consent arrangement.
RoamAid routinely retains audio rather than written transcripts. When specifically requested and justified for a legal or similar purpose, RoamAid may privately commission a transcript through an authorized company, subject to access restrictions and retention and preservation rules.
RoamAid does not use AI to analyze call recordings. Any proposed change must undergo separate review and approval before implementation, including required customer disclosures and consent procedures.
Routine recordings are normally retained for up to five years after the applicable Trip Protection ends. Records relating to a safety incident or HELP request-including relevant audio, messages, check-ins and actions taken-are retained for seven years after case closure or the relevant Trip Protection’s end, whichever is later. Routine unrelated check-in records are normally retained for one year after the trip ends. Records that become incident evidence follow the incident rule.
Legal obligations or preservation holds may require longer retention. Valid deletion requests are reviewed subject to applicable exceptions. The Privacy Policy explains other retention categories, access restrictions, safeguards, provider processing and deletion. Retention does not authorize use of recordings for advertising or retargeting.
14. Misuse, suspension and termination
RoamAid may reasonably restrict, suspend or terminate Services because of fraud, unlawful activity, intentional misuse, materially false information, threats or abuse toward personnel or providers, interference with systems, nonpayment or reversed payment, or another material breach, subject to applicable law.
Suspicious communications. If you receive a call, message, website link or payment request that appears to be from RoamAid but seems suspicious, do not provide card information or verification codes through it. Contact RoamAid using the contact information on our official website or in your confirmed booking so we can investigate.
During an active safety situation, RoamAid will use reasonable efforts not to abruptly discontinue an ongoing assistance interaction where that would create an immediate safety concern, while retaining the ability to protect personnel and providers. Applicable nonwaivable rights and refund provisions remain effective.
15. Warranties and liability
To the maximum extent permitted by law, Services are provided on an “as available” basis. Except for express commitments in these Terms, RoamAid disclaims implied warranties and conditions, including merchantability, fitness for a particular purpose and noninfringement, to the extent they may lawfully be disclaimed. RoamAid does not warrant uninterrupted, timely, secure or successful service, or the conduct, accuracy, availability or outcome of independent third parties.
To the maximum extent permitted by law, RoamAid excludes liability for indirect, incidental, special, consequential and exemplary damages. For claims that the law permits RoamAid to limit, ROAMAID INC’s total aggregate liability arising out of or relating to a particular Trip Protection purchase will not exceed the greater of the amount you paid for that purchase or $100.
Nothing here excludes or limits liability, warranties, rights or remedies that applicable law does not permit to be excluded or limited. These provisions do not authorize RoamAid to disregard an express commitment.
16. Indemnification
To the maximum extent permitted by law, you will defend, indemnify and hold harmless ROAMAID INC and its officers, directors, employees, agents and service providers from third-party claims, liabilities, damages, losses and reasonable costs arising from your unlawful conduct, intentional misuse of Services, material violation of these Terms, infringement of another person’s rights, or knowingly false or unauthorized information supplied to RoamAid.
This obligation does not apply to the extent the claim or loss results from RoamAid’s conduct for which liability cannot lawfully be shifted to you. It is not an unlimited indemnity for everything connected with the Services.
17. Individual arbitration, class-action waiver and opt-out
17.1 Covered disputes
Except as provided below, you and ROAMAID INC agree to resolve disputes between you arising out of or relating to the applicable purchase, these Terms or Services through binding individual arbitration rather than a court trial. For arbitrated claims, both parties give up a trial before a judge or jury. The Federal Arbitration Act governs this arbitration agreement to the extent applicable; otherwise applicable arbitration law governs. An award may be entered in a court with jurisdiction, subject to legally available review.
17.2 Informal resolution
Before starting covered arbitration, the complaining party must provide written notice identifying the relevant purchase, explaining the dispute and requested resolution, and supplying contact information. Send your notice to info@roamaid.me with the subject “Notice of Dispute.” RoamAid will send its notice to your supplied email address or another agreed written contact method.
The parties will attempt in good faith to resolve the dispute for 30 calendar days after receipt. To the extent legally permitted, the parties agree to suspend applicable limitation periods for the noticed dispute during that period. This procedure does not prevent an eligible small-claims case, a necessary protective filing to preserve a deadline, or genuinely urgent interim court relief. Such a filing does not itself waive arbitration of the underlying arbitrable dispute. Reasonable notice defects should be addressed by an opportunity to correct them rather than automatic forfeiture of a claim.
17.3 Administrator and rules
AAA will administer covered consumer arbitrations under its Consumer Arbitration Rules in effect when filed and, where applicable, its Mass Arbitration Supplementary Rules. Rules, filing instructions and fee information are available at https://www.adr.org/rules-forms-and-fees/consumer/.
If AAA is unavailable or unwilling to administer a dispute, the parties will seek agreement on another nationally recognized administrator with appropriate consumer protections. If they cannot agree, either may ask an appropriate court to appoint an administrator or arbitrator as permitted by law. This fallback does not eliminate rights arising from RoamAid’s failure to pay required fees or comply with applicable rules or law. If no lawful arbitration process remains available, the dispute may proceed in a competent court.
17.4 Fees, hearing and remedies
Fees and arbitrator compensation will be allocated under the applicable AAA consumer rules, fee schedule and law. RoamAid will pay amounts those rules or law require it to pay. Consumers may use available fee-waiver procedures. Each party ordinarily bears its own legal expenses, except where applicable law or a permissible award provides otherwise; this does not remove a statutory right to recover attorney fees.
Proceedings will ordinarily be remote by video, telephone or written submissions as permitted by the rules. An in-person hearing remains available if required by the rules, ordered by the arbitrator or agreed by the parties. Its location must comply with applicable consumer rules and law; these Terms do not require a consumer to travel to California for an arbitration hearing.
The arbitrator may award relief available for the individual claim under applicable law and enforce these Terms only to the extent lawful. Courts decide disputes concerning formation or enforceability of this arbitration agreement, the class waiver and the exceptions below; the arbitrator decides the merits of properly arbitrated claims.
17.5 Individual proceedings and exceptions
To the extent permitted by law, covered claims must proceed individually, not as a class or collective action or class arbitration. Neither party agrees to class arbitration. Application of AAA mass-arbitration procedures to separately filed individual claims does not itself authorize class arbitration.
Either party may bring an individual claim in an appropriate small-claims court if it qualifies and remains there individually. Either party may contact government agencies or exercise rights that cannot lawfully be subjected to arbitration or waived.
Nothing here waives a nonwaivable right to seek public injunctive relief. Requests for such relief are reserved for a competent court, while separable arbitrable claims remain subject to arbitration to the extent permitted by law. Any stay or sequencing is for the court to decide under applicable law. Necessary urgent interim relief may also be sought in court without waiving arbitration of the underlying arbitrable dispute.
17.6 Thirty-day opt-out for each purchase
You may opt out of this arbitration agreement for a particular purchase by sending an email to info@roamaid.me within 30 calendar days after that purchase. Use the subject “Arbitration Opt-Out,” include your name and Trip ID or other information reasonably sufficient to identify the purchase, and clearly state that you opt out of arbitration for that purchase. An electronic signature consisting of your typed name is sufficient. Retain a copy of your sent request. RoamAid’s delayed acknowledgment does not invalidate a timely, sufficiently identifiable opt-out.
A valid opt-out removes this Section 17’s arbitration agreement and class-action waiver for that purchase. The other Terms remain in effect. Each new purchase has its own 30-day opportunity; an earlier opt-out does not automatically apply to a later purchase, and a later purchase does not cancel an earlier valid opt-out.
17.7 Severability and limits
If part of this section is unenforceable, it will be narrowed or severed where legally permitted while preserving the enforceable remainder. If an individual-proceeding waiver cannot lawfully be enforced for a particular claim, that claim will proceed in court rather than class arbitration. No severability rule removes nonwaivable remedies or creates arbitration without legally sufficient agreement. These Terms do not treat a purchaser’s listing of another traveler, including a child, as automatic proof of that traveler’s assent or a valid waiver of independent rights.
18. Governing law and court venue
California law governs these Terms except where applicable law requires otherwise, with arbitration law treated as stated above. Disputes not required to be arbitrated and not properly brought in small-claims court will proceed in an appropriate California state or federal court, subject to nonwaivable jurisdiction, venue and consumer-protection rights.
19. Contract administration
RoamAid may revise these Terms prospectively. The version accepted for a purchase generally governs that trip. A later version does not silently rewrite an existing purchase, except where required by law or expressly agreed by the customer.
ROAMAID INC may assign this agreement in connection with a merger, acquisition, restructuring, sale of substantially all relevant assets or similar legitimate transaction. You may not transfer Trip Protection or contractual rights to another person without RoamAid’s written approval.
A failure or delay to enforce a provision does not permanently waive it. Unenforceable provisions will be narrowed or severed as legally appropriate, with Section 17’s special rules controlling arbitration. Provisions that by their nature continue after expiration or termination-including applicable payment obligations, dispute provisions, liability limits and indemnification-survive to the extent lawful.
These Terms, the specific purchase information and any expressly incorporated service-specific terms constitute the agreement concerning that purchase. They supersede conflicting prior statements, without eliminating express commitments or nonwaivable rights.
